These Terms of Service ("Terms") govern your use of Zypher's AI oracle service at zypherit.com (the "Service"). By using the Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

Zypher is an AI-powered oracle service that provides insights and guidance based on various divination algorithms. The Service includes:

AI oracle consultations
Multiple divination algorithms (26 methods)
Conversation history storage
Subscription-based premium features

3. Account Registration

3.1 Eligibility

You must be at least 13 years old to use the Service. By registering, you represent that you meet this requirement.

3.2 Account Security

You are responsible for:

Maintaining the security of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access

4. Subscription and Payments

4.1 Free Tier

5 oracle consultations per 7-day period
Access to basic oracle model (Arch)
Automatic reset each period

4.2 Paid Subscriptions

Plus	$20/month	Unlimited consultations, all models
Pro	$60/month	Everything in Plus, 4× usage capacity
Ultra	$200/month	Everything in Pro, 15× usage capacity, priority support

4.3 Billing

Subscriptions are billed monthly in advance
Payments are processed securely through a third-party payment processor
Prices are in USD and may be subject to applicable taxes

4.4 Upgrades and Downgrades

Upgrades: Take effect immediately with prorated billing
Downgrades: Take effect at the end of the current billing period
You can manage your subscription through the Billing Portal in Settings

4.5 Cancellation

You may cancel your subscription at any time. After cancellation:

You retain access until the end of the current billing period
No further charges will be made
Your account reverts to the Free tier

5. Refund Policy

5.1 Eligibility

You may request a full refund if ALL of the following conditions are met:

The request is made within 7 days of the initial subscription purchase
You have used the Service no more than 10 times during this period
This is your first refund request for the Service

5.2 How to Request

To request a refund:

Email team@zypherit.com with the subject "Refund Request"
Include your registered email address
Briefly explain your reason (optional but helpful)

5.3 Processing

We will review your request within 3 business days
Approved refunds are processed to the original payment method
Refunds typically appear within 5-10 business days

5.4 Non-Refundable

The following are NOT eligible for refunds:

Requests made after 7 days
Accounts with more than 10 uses
Subsequent months of subscription
Upgrade price differences (prorated amounts)

6. Acceptable Use

6.1 You Agree NOT To:

Use the Service for illegal purposes
Attempt to reverse-engineer or exploit the Service
Harass, abuse, or harm others through the Service
Share your account with others
Use automated systems to access the Service (bots, scrapers)
Circumvent usage limits or restrictions

6.2 Content Guidelines

You are responsible for the content you submit. Do not submit content that:

Is illegal or promotes illegal activities
Infringes on others' intellectual property
Contains malware or harmful code
Is fraudulent or deceptive

7. Intellectual Property

7.1 Our Content

The Service, including its design, algorithms, branding, and content, is owned by Zypher and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

7.2 Your Content

You retain ownership of the content you submit. By using the Service, you grant us a limited license to:

Process your content to provide the Service
Store your content for your future access
This license terminates when you delete your content or account

The oracle readings and guidance provided by Zypher are:

For entertainment and personal reflection purposes only
NOT professional advice of any kind
NOT a substitute for professional medical, legal, financial, psychological, or other expert advice

You acknowledge and agree that:

Oracle results are generated by AI algorithms and should be interpreted as one perspective among many
You should NOT make important life decisions based solely on oracle readings
You are solely responsible for any decisions or actions you take
We make no guarantees about the accuracy, completeness, or usefulness of any oracle reading

If you are experiencing a crisis or need professional help, please consult qualified professionals or emergency services.

8.2 Service Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

Merchantability
Fitness for a particular purpose
Non-infringement
Availability or reliability

9. Limitation of Liability

To the maximum extent permitted by law:

Zypher shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
This limitation applies regardless of the theory of liability

10. Indemnification

You agree to indemnify and hold harmless Zypher, its officers, employees, and agents from any claims, damages, or expenses arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights

11. Modifications to Service

We reserve the right to:

Modify or discontinue any part of the Service
Change pricing with reasonable notice
Update these Terms

Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.

12. Termination

12.1 By You

You may terminate your account at any time through Settings or by contacting us.

12.2 By Us

We may suspend or terminate your account if you:

Violate these Terms
Engage in fraudulent or illegal activity
Abuse the Service or other users

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Delaware.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
